Hoover's Auctions & Real Estate, LLC Online Auction Terms & Conditions

By registering to bid in this online auction, you acknowledge and agree to the following Terms & Conditions. Bidding in this auction constitutes a binding legal agreement between the bidder and Hoover’s Auctions & Real Estate, LLC (“Auctioneer”).

1. Registration & Bidding Eligibility

  • All bidders must be at least 18 years of age and legally capable of entering into a binding contract.
  • A valid credit/debit card is required to register.
  • The Auctioneer reserves the right to approve or deny bidder registration at their discretion

2. Buyer’s Premium

  • A Buyer’s Premium (typically 7-10%) will be added to the final bid amount and is payable by the buyer as part of the total purchase price.
  • The Buyer’s Premium may vary by item and will be disclosed in the auction listing.

3. Payment Terms

  • Payment must be made in full within 12 hours of the auction closing.
  • Accepted forms of payment include credit/debit card, wire transfer, cash, or certified check. Any payments made by wire transfer will be subjected to the $30 wire transfer fee.
  • Winning bidders will receive an invoice by email. Late or failed payments may result in forfeiture of the item and banning from future auctions.
  • If you fail to pick up your items, we will charge your credit card.
  • Any payments made by credit card will be subjected to a 3% card processing fee, to be paid by the buyer. 

4. Sales Tax

  • All sales are subject to 6% Kentucky Sales Tax. Applicable sales tax will be charged unless a valid resale or exemption certificate is provided before the auction ends. 

5. As-Is / Where-Is

  • All items are sold as-is, where-is with no warranties or guarantees expressed or implied, including merchantability and/or fitness for particular purpose.
  • Bidders are responsible for inspecting all items and conducting their own due diligence before placing bids.
  • All descriptions and information are believed correct, but are not guaranteed and as such the Auctioneers, Hoover's Auctions & Real Estate, LLC, and/or the Seller shall not be held liable for inaccuracies in the information.

6. Auction Closing & Bidding

  • This auction uses a soft close feature: if a bid is placed within the final __ minutes of bidding, the lot will extend by __ additional minutes.
  • The Auctioneer reserves the right to extend, pause, or cancel bidding due to technical issues or at its discretion.

7. Removal & Pickup

  • Winning bidders are responsible for removal of purchased items within the specified pickup window.
  • Pickup dates, times, and location will be stated in the auction listing. Failure to pick up items on time may result in storage fees or forfeiture of items without refund.
  • Buyers are responsible for packing, loading, and transporting items.
  • Buyers are responsible for the cost of shipping their items if necessary.

8. Default & Non-Payment

  • If the winning bidder fails to complete payment or pickup, the Auctioneer may, at its sole discretion, resell the item, pursue legal action, or ban the bidder from future auctions.
  • Unless special arrangements are made with the auctioneer, for any items not paid for and/or not picked up by the winning bidder within SEVEN (7) days of the date payment was due, the property shall be considered abandoned and any interest the winning bidder may have in the property shall revert back to the seller or auctioneer, and there shall be no refunds to the winning bidder.
  • Failure to pay for or pick up your items will result in the loss of future bidding opportunities. 

9. Disputes & Arbitration

  • Any disputes arising out of this auction shall be governed by the laws of the State of Kentucky.
  • All claims must be settled through binding arbitration in Christian County, Kentucky, with each party responsible for its own legal fees.

10. Technology Disclaimer

  • Hoover's Auctions & Real Estate, LLC is not responsible for technical failures or bidding platform errors. Bidders are encouraged to bid early and monitor their bids closely.
  • In the event of a system failure, the Auctioneer may extend or reschedule the auction at its discretion.
  • While very rare, the Auctioneers, Hoover's Auctions & Real Estate, LLC., Sellers, and the Internet and Software Providers do not guarantee or warrant the online bidding procedure and/or system to operate without interruption or malfunction and shall not be held responsible in the event of such.

11. Changes & Updates

  • These Terms & Conditions are subject to change without notice. It is the bidder’s responsibility to review them prior to each auction.

12. Penalties

  •  Any bidding found to be fraudulent and/or negligence to provide proper payment in the allotted time will result in all appropriate legal action.
  • Any invoice not fully and properly paid for in the allotted time will be charged to the credit card account presented at registration and the items forfeited.
  • Delinquencies will be noted and will prevent the individual from participating in any further live or online auctions conducted by Hoover's Auctions & Real Estate, LLC.
  • Hoover's Auctions & Real Estate, LLC retains the right to prevent anyone from participating in this and future online auctions who does not abide by the terms and conditions of the auction or whose actions are not in the best interest of our client, the Seller.

13. Auctioneer's Representation and Right to Bid

  •  In accordance with KRS330.220(6)(a), it is hereby disclosed that, with permission from the seller, the auctioneer and any auction staff members have the right to bid. Hoover's Auctions & Real Estate, LLC and the auctioneer are agents of the seller.

14. Registration

  • Bidders must register with a full name, email address, home/business address, telephone number, and valid credit card information. Credit card information is obtained to establish bidder legitimacy, deter defunct bidding and charge the account at your request or in the event you do not pick up your items. Registration may only be completed with an acknowledgment that the bidder has read and understood all terms and conditions for the sale and online bidding.
